These Terms of Service ("Terms") govern your access to and use of BuildBid (the "Service"), operated by Protelynx ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

BuildBid is an AI-powered construction estimating platform. Users can upload or photograph construction blueprints, and our AI extracts room layouts, materials, and quantities to generate detailed cost estimates mapped against a commercial cost database.

2. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate, current, and complete information during registration.

3. Free Tier and Subscriptions

Free Tier: All users receive 3 free estimates. Free estimates include full AI processing and line-item detail.

Pro Subscription: Unlimited estimates, priority processing, and additional features are available through a paid Pro subscription. Subscription pricing, billing cycles, and cancellation terms are displayed at the time of purchase. Payments are processed by Stripe.

We reserve the right to modify pricing with 30 days' notice. Changes do not affect the current billing cycle.

4. AI-Generated Estimates Disclaimer

Important: All estimates generated by BuildBid are AI-produced approximations intended as a starting point for professional review. They are not a substitute for professional cost estimation, engineering analysis, or architectural review. You must independently verify all estimates before relying on them for bidding, contracting, purchasing, or any financial decisions. Protelynx is not responsible for inaccuracies in AI-generated estimates.

5. User Responsibilities

• Provide accurate and complete construction documents for processing
• Review all AI-generated estimates before using them in professional contexts
• Ensure you have the right to upload any documents you submit to the Service
• Comply with all applicable laws and regulations in your use of the Service
• Not use the Service for any unlawful purpose or to violate any third-party rights

6. Intellectual Property

Our IP: The Service, including its AI models, software, design, and branding, is owned by Protelynx and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

Your Content: You retain ownership of all documents you upload and estimates generated from your documents. By uploading content, you grant us a limited license to process, store, and display it solely to provide the Service to you.

7. Limitation of Liability

To the maximum extent permitted by law, Protelynx shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Delaware.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Continued use of the Service after changes constitutes acceptance.
